Twist in Malloti Case: Prophet Java Withdraws Cyberbullying Charges, But Police Insist on Court Appearance

Harare, Zimbabwe – In a dramatic turn of events, controversial socialite and dancehall sensation Millicent Tsitsi Chimonyo, popularly known as Malloti, is still expected to appear in court today to face cyberbullying allegations, despite the complainant, Prophet Passion Java, having reportedly withdrawn the charges.

The situation has created a complex legal scenario, as police are reportedly insisting that the withdrawal must be formally processed through the court system. This means Malloti, who is heavily pregnant and has been in custody for two nights, must still face a magistrate.

Charges Withdrawn, But Court Appearance Looms

The latest development reveals that Prophet Passion Java has opted to withdraw the cyberbullying complaint he filed against Malloti. According to sources, the prophet asked to send a withdrawal affidavit to formalize his decision. However, this did not secure her immediate release.

Police officials have reportedly insisted that due to the nature of the case and the fact that it had been officially processed, the matter must be withdrawn in court. The court will now have the final say, deciding whether to formally withdraw the charges based on the complainant's request or to consider other options, such as releasing Malloti on bail pending further proceedings.

Background of the Arrest and Health Concerns

Malloti was reportedly arrested on Tuesday, accused of cyberbullying the controversial clergyman Prophet Passion Java in June. She has been held in police custody at Machipisa police station since her arrest.

The detention has raised significant health concerns, as Malloti is heavily pregnant and reportedly unwell. Her lawyer, Dumisani Mthombeni, expressed grave concerns for his client's well-being and that of her unborn child.

Speaking to H-Metro, Mthombeni confirmed the details: "I do confirm that she is currently held in police cells at Machipisa police station since yesterday (Monday) around 4pm. Client says she was not told of the reason for arrest yesterday and was only told this morning (Wednesday). It’s alleged she was arrested for cyber bullying and complainant is alleged to be one Passion and I’m yet to get the full details of the alleged complainant."

Mthombeni highlighted the urgency of her medical situation: "Client told me that she is currently unwell and fears for the good health and life of her baby. **She is due to deliver anytime this week through inducement due to pregnancy complications**," he stated.

What Happens Next?

With Prophet Java's withdrawal on record but the police insisting on a formal court process, all eyes are on the Harare Magistrate's Court today. The court's decision will determine the immediate future for the controversial socialite.

The case has already generated significant public interest, highlighting the legal ramifications of online conduct and the complex procedures involved when a complainant decides to withdraw charges after police have initiated proceedings.
