I am still trying to verify the authenticity of Issa Tchiroma's report. If truly Sisiku Ayuk Tabe and his cohorts have been smuggled in to Cameroon just like Issa Tchiroma said, then there's a high probability that they were illegally deported or extradited to Cameroon.
In other-words, their rights have been violated by Buhari's government.
The manner in which they were deported or extradited to Cameroon ( as described by Issa Tchiroma) doesn,t comply with the legal extradition or the deportation proceedings of Nigeria.
Like in mentioned in one of my posts. If an alleged criminal is to be extradited by the Nigeria government to the country where he or she has been accused of committing a crime, the Nigeria government first need to file a case to the high court in Abuja requesting permission for the extradition of the alleged criminal. The person to be extradited also has the right to hire a lawyer to contest or oppose the extradition i.e. if he or she doesn't want to be extradited. Extradition case can be liken to divorce; where you cannot wake up from bed and decide to send away your wife because someone told you she's a criminal. To divorce your wife, you will need to sue for divorce(irrespective of the crime she has committed) and the decision will be taken by a judge and not you (after the judge has carefully examined your motives).
Let me cite the 2013 extradition case of Lawal Olaniyi Babafemi, aka “Abdullah” or “Ayatollah Mustapha”, a member of Al-Qaeda in the Arabian Peninsula (AQAP) who was extradited from Nigeria to US to stand trial on four charges in the United States.
Before Lawal Olaniyi Babafemi; the Al-Qaeda terrorist was extradited to US by the Nigerian Government, the Nigerian government first had to file a case to the high court in Abuja requesting for permission to extradite Lawal Olaniyi Babafemi (even though US had signed an extradition treaty with Nigeria). It was Justice Ahmed Mohammed of the federal high court in Abuja who passed an order that Lawal Olaniyi Babafemi be extradited to the United States of America to face the indictment against him.
The 33-year-old Babafemi did not contest the extradition. His lawyer said he had been in the custody of Nigeria’s intelligence agency for two years. Babafemi didn,t even speak in court other than to confirm to the judge that he did not oppose the extradition.
THAT IS THE LEGAL EXTRADITION PROCEDURE OF NIGERIA.
The above facts clearly suggest that a tough legal proceeding always precede extradition and all those legal procedures which precede extradition can never take place behind the scene.
As of now, the Nigerian government haven,t filed any case to the Abuja high court in Nigeria requesting for the extradition of Sisiku and his cohorts. Sisiku and his cabinet members haven,t seen a lawyer since they were arrested on the 5th of January, 2018. Few weeks ago, a renowned Nigerian human rights lawyer and activist, Femi Falana was denied access to Sisiku Ayuk Tabe by DSS.
If Sisiku Ayuk Tabe and his cabinet members were extradited or deported by the Nigeria government without following the legal extradition or deportation procedure, then the right of Sisiku Ayuk Tabe Julius and co have been violated.
